Heard learned counsel for the petitioners and learned Additional Government Advocate.
The order dated 19.05.2007 passed by the SubCollector, Sadar, Cuttack in O.E.A. Appeal No.9 of 2006 impugned in this writ petition is revisable under Section 38-B of the Orissa Estates Abolition Act, 1951 before the Board of Revenue.
Hence, this writ petition is allowed to be withdrawn for filing of an appropriate application before the Board of Revenue within fifteen days hence. If an application for condonation of delay is filed, the same shall be considered taking into account the provision of Section 14 of the Limitation Act, 1963.
The petitioners are allowed to take back the certified copy of the impugned order by substituting authenticated Xerox copy thereof.
Accordingly, this writ petition is disposed of.
