Ramakanta Kumbha and Opposite Party No.2Prabhasini Kumbha @ Mahananda. The other petitioners are in-laws members. An affidavit has been filed by the Opposite Party No.2-wife stating therein that at her instance, a petition was filed under Section 13(1) of the Hindu Marriage Act and decree of divorce has been passed by the learned Senior Civil Judge, Bargarh in MAT SUIT No.13/50 of 2011. In the said divorce proceeding, a compromise petition was prepared, in which it was resolved between the parties that the petitioner will pay Rs.1,00,000/- and on the date of petition for compromise, the petitioner has paid Rs.30,000/- and Rs.70,000/- was remain unpaid. But, during the pendency of this petition, the said amount has already been paid by way of bankdraft and as such, both of them have agreed to make a happy end of their matrimonial relationship. The Opposite Party No.2-wife further stated in the affidavit that in view of the aforesaid mutual settlement between them, she does not want to proceed further against the petitioners in this case. 4.
