The offences alleged are under Secs.450/395, I.P.C. and the allegations are to the extent that some unknown persons by breaking upon the door, entered the liquor bhati of the informant and forcibly took away some liquor pouches including cash of Rs.6800/-.
It is submitted on behalf of the petitioner that the petitioner is inside custody since 29.7.2019 and nothing has been seized from the possession of the present petitioner, which is agrees by the learned Additional Standing Counsel for the State. It is further submitted that on the basis of the statement of the coaccused, the present petitioner has been taken into custody.
Considering all such materials and the period of detention of the petitioner inside custody, it is directed to release the petitioner on bail in connection with Khariar P.S. Case No.96/2019 corresponding to C.T. Case No.126/2019 on such terms and conditions to be fixed by the learned court below in seisin over the matter including the condition that the petitioner shall not involve any other offence while on bail and shall appear before the IIC, Khariar PS once in each fortnight for a period of six months from the date of his release. It is made clear that violation of any of such conditions shall entail cancellation of his bail.
The BLAPL is accordingly disposed of.
