The petitioners being in custody in connection with Malkangiri Excise P.R. Case No. 19 of 2019-20 corresponding to T.R. Case No. 70 of 2019 on the file of learned Sessions Judge-cum-Special Judge, Malkangiri running for alleged commission of offence under section 20(b)(ii)(C) of the NDPS Act, have filed this application under section 439 of Cr.P.C for their release on bail.
Heard learned counsel for the petitioners and learned counsel for the State.
Considering the submissions made and on going through the materials including the quantity of contraband ganja said to have been seized from the possession of the petitioners on record; further keeping in view the surrounding circumstances of the case, at this stage, I am not inclined to accept the prayer for grant bail to the petitioners.
The BLAPL is accordingly dismissed.
