21.06.2019 Heard the learned counsel for the petitioner and learned counsel for the State.

This is an application under section 439 Cr.P.C. in connection with C.T. Case No.276 of 2019 arising out of Dharmasala P.S. Case No. 79 of 2019 pending in the Court of learned J.M.F.C., Chandikhole for offences punishable under sections 461/379/34 of the Indian Penal Code.

The prayer for bail of the petitioner was rejected by the learned Asst. Sessions Judge, Chandikhole vide order dated 16.05.2019.

Considering the submission made by the learned counsel for the petitioner that the petitioner is in judicial custody since 14.03.2019, investigation has made substantial progress, offences are triable by Magistrate and after hearing the learned counsel for the State, I am inclined to release the petitioner on bail.

Let the petitioner be released on bail in the aforesaid case on furnishing bail bond of Rs.20,000/-(rupees twenty thousand) with two solvent sureties each for the like amount to the satisfaction of the Court in seisin over the matter with further terms and conditions as the learned Court may deem just and proper.

Accordingly, the BLAPL is disposed of.

Urgent certified copy of this order be granted on proper application.
