This is an application under section 439 Cr.P.C. in connection with G.R. Case No.588 of 2017 arising out of Patnagarh P.S. Case No. 194 of 2017 pending in the Court of learned S.D.J.M., Patnagarh for offence punishable under sections 379/34 of the Indian Penal Code.
The prayer for bail of the petitioners was rejected by the learned Addl. Sessions Judge, Patnagarh vide order dated 09.05.2019.
Considering the submission made by the learned counsel for the petitioners that the petitioners were taken on remand in this case on 05.03.2018, investigation has made substantial progress, the offence is triable by Magistrate and after hearing the learned counsel for the State, I am inclined to release the petitioners on bail.
Let the petitioners be released on bail in the aforesaid case on furnishing bail bond of Rs.20,000/-(rupees twenty thousand) each with two solvent sureties each for the like amount to the satisfaction of the Court in seisin over the matter with further terms and conditions as the learned Court may deem just and proper.
Accordingly, the BLAPL is disposed of.
