Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 439 Cr.P.C. in connection with Jeypore Sadar P.S. Case No.204 of 2018 corresponding to G.R. Case No.1212 of 2018 pending in the Court of learned S.D.J.M., Jeypore for alleged commission of offences under section 395 of the Indian Penal Code.

Learned counsel for the petitioner submitted that the petitioner is in judicial custody since 02.12.2018 and in the meantime after completion of investigation, charge-sheet has already been submitted under section 395 of the Indian Penal Code against the petitioner and other co-accused persons, who have already been released on bail in BLAPL No.1184 of 2019. He further submitted that since the petitioner is similarly situated like that of the co-accused persons and there is no criminal antecedent against the petitioner, the bail application may be favourably considered.

Learned counsel for the State has produced the case diary and after verification of the same, fairly submitted that there is no criminal antecedent against the petitioner.

Considering the submissions made by the learned counsel for the respective parties, nature of accusation against the petitioner, release of the co-accused persons on bail and taking into account the period of detention of the petitioner in judicial custody, I am inclined to release the petitioner on bail.

Let the petitioner be released on bail in the aforesaid case on furnishing a bail bond of Rs.20,000/- (rupees twenty thousand) with two local sureties each for the like amount to the satisfaction of the learned Court in seisin over the matter and with further conditions as the learned Court may deem just and proper.

The BLAPL is accordingly disposed of.
