Learned counsel for the petitioner submitted that the petitioner is in judicial custody since 06.11.2018 and in the meantime after completion of investigation, charge-sheet has already been submitted under sections 366, 376(2)(n) and 306 of the Indian Penal Code. He further submitted that the materials available on record indicate that the deceased was a consenting party and she was major girl and she eloped with the petitioner on account of love affairs and both the petitioner and the deceased belonged to the same village. It is further submitted that when they both returned to their village, they were pressurized not to keep any relationship with each other and for that reason affidavits were sworn by the petitioner as well as the deceased and thereafter the deceased committed suicide and in such circumstances, it cannot be said that there was any material regarding abetment of commission of suicide by the petitioner and therefore, the bail application may be favourably considered. Learned counsel for the petitioner placed the affidavits of the petitioner as well as the deceased, which are annexed to the bail application.
