because one of the co-accused Dibakar Dora has been released on bail in the meantime in BLAPL No. 3839 of 2018 vide order dated07.12.2018 as the petitioner stands in a different footing than that of the co-accused Dibakar Dora. However, since framing of charge is getting delayed for two reasons, firstly, for non-production of SFSL report and secondly, for apprehension of the co-accused Rabi Dora, the IIC of Ranpur Police Station is directed to collect the SFSL report and produce it before the learned Addl. Sessions Judge, Nayagarh on or before 28th June, 2019 and if by the next date fixed, the co-accused Rabi Dora is not apprehended, then the case against him be splitted up and the learned trial Court shall proceed to frame charge against the petitioner in accordance with law and at the first instance, examine the eye witness Suresh Chandra Pradhan and in that respect, the trial Court shall take the assistance of the IIC, Ranpur Police Station for service of summons on the aforesaid eye witness and after the said witness is examined, the petitioner is at liberty to move the prayer for bail before the learned trial Court.
