Learned counsel for the petitioner submitted that the petitioner is in judicial custody since 16.01.2019 and he has been charge-sheeted under sections 353, 395, 307, 323, 325 of the Indian Penal Code and section 25 of the Arms Act. It is further submitted that the informant Anil Kumar Parida, who happens to be the brother of the vitim Sunil Parida, is serving in the Police Department and as per the F.I.R., the prosecution case is that the co-accused persons, namely, Akash, Kuni, Kunal, Salu and others assaulted the brother of the informant by means of different weapons and also looted gold chain, ring and mobile phone. The injured became senseless and he was shifted to District Headquarters Hospital, Phulbani and on receipt of the information about the incident and hospitalization the informant came to the hospital and when the injured got back his sense, he disclosed about the occurrence and after hearing from the injured as well as from other witnesses, the F.I.R. has been lodged but in the F.I.R., the name of the petitioner does not find place.
