Learned counsel for the petitioner submitted that the petitioner is in judicial custody since 31.12.2018 and he has been charge-sheeted under sections 498-A, 306 of the Indian Penal Code. It is further submitted that the petitioner is the younger brother in-law of the deceased Rubi @ Kamala @ Kalyani Jena. The marriage of the deceased with the elder brother of the petitioner was solemnized on 16.07.2009 and they were blessed with one son and a daughter and the husband of the deceased was having psychiatric problem and on 28.01.2017 he died. Learned counsel for the petitioner further submitted that allegations have been brought on record that after the death of the husband of the deceased, the petitioner was trying to keep physical relationship with the deceased, which was opposed to by her and in that connection, he was also giving physical and mental torture to the deceased and demanding some money from her. On 11.08.2018 the deceased committed suicide by hanging. Learned counsel further submitted that the post mortem report indicates that there was no external injury on the person of the deceased except a ligature mark around her neck. Even though the informant alleged in his statement regarding misconduct of the petitioner after the death of the husband of the deceased, but in an affidavit filed before this Court, he has not alleged against the petitioner or his family members that they are responsible for the death of his daughter.
