Since the dispute involves a private bank, the writ petition is not maintainable. It is at this stage, Sri Kar, learned counsel for the petitioner seeks withdrawal of the writ petition with liberty to the petitioner to approach the appropriate forum. Accordingly, the writ petition stands dismissed as withdrawn but however with liberty as prayed for.
Interim order dated 4.11.2009 passed by this Court stands vacated.
