This petition challenges the order dated 19.07.2018, passed by the learned Civil Judge (Junior Division), Bhawanipatna, in C.S. No.02 of 2017 whereby and whereunder, learned trial Judge rejected the application of the defendant nos.1 to 4 filed under Section 11 of C.P.C.
Res judicata is a mixed fact of law. The same
can be decided in trial.
The petition sans merit, the same is
accordingly dismissed.
