C.M.P. No.1162 of 2018
This petition challenges the order dated 10.5.2018 passed by the learned Civil Judge (Sr. Divn.), Soro in C.S. No.460 of 2003. By the said order, learned trial court has rejected the application filed by the defendants for stay of proceeding of the suit.
Heard Mr. M.K. Mohanty-2, learned counsel for the petitioner.
Learned trial court observed that the probate case has been dismissed for non-prosecution. Thus, the learned trial court has quite justified in rejecting to stay the further proceedings of the suit.
Accordingly, the petition is dismissed.
