This petition challenges the order dated 17.2.2018, passed by the learned Civil Judge (Senior Division), Umerkote, Nawarangpur, in C.S. No.13 of 2016. By the said order, learned trial Judge rejected the application of the defendant filed under Order 11 Rule 14 C.P.C.
Learned trial Court came to hold that plaintiff-P.W.4 during his cross-examination has categorically denied the fact that the original document has been handed over to him and he is possessing the same.
In view of the above, learned trial Judge was justified in dismissing the application of the defendant for production of original document.
Petition is dismissed.
