This is an application under Section 439 Cr.P.C. in connection with C.T. Case No.1003 of 2018 arising out of Bayree P.S. Case No.87 of 2018 pending in the Court of learned J.M.F.C., Chandikhole for offences punishable under sections 399/402 of the Indian Penal Code and sections 3 and 4 of the Explosive Substances Act.
The petitioners moved an application for bail before the learned Addl. Sessions Judge, Jajpur which was rejected on 15.11.2018.
Considering the submissions made by the learned counsel for the petitioners that the petitioners are in judicial custody since 08.08.2018, charge sheet has already been submitted and taking into account the nature of accusation against the petitioners, after hearing the learned counsel for the State, I am inclined to release the petitioners on bail.
Let the petitioners be released on bail in the aforesaid case on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) each with two solvent sureties each for the like amount to the satisfaction of the Court in seisin over the matter with further terms and conditions as the learned Court may deem just and proper.
Accordingly, the BLAPL is disposed of. Urgent certified copy of this order be granted on
proper application.
