The petitioner being in custody in connection with Kumbharpada P.S. Case No.67 of 2018 corresponding to G.R. Case No.479 of 2018 charge sheeted under sections 307/326/120-B/323/324/34 IPC read with section 25 of Arms Act pending in the court of the learned S.D.J.M., Puri has filed this application under section 439, Cr.P.C. for his release on bail.

Learned counsel for the petitioner submits that the injured of the case having been discharged from the hospital is now doing his normal work and there remains no scope of conversion of the case for any graver offence. In view of all the above, further detention of the petitioner in custody as also the progress of the investigation and other surrounding circumstances as also in the absence of any other impediment, he urges for grant of bail to the petitioner.

Learned counsel for the State opposes the move.

Considering the submissions made and on going through the materials available on record; further keeping in view the surrounding circumstances including the period of detention of the petitioner in custody, it is directed that the petitioner be released on bail in the aforesaid case with such terms and conditions as deemed just and proper by the court in seisin of the case with further conditions that he will appear in person before the court in seisin of the case on each date of posting of the case till conclusion of the trial.

The BLAPL is accordingly disposed of. Issue urgent certified copy as per rules.
