This is an application under Section 439 Cr.P.C. for grant of bail to the petitioner in connection with Badambadi P.S. Case No.175 of 2018 corresponding to G.R. Case No.1111 of 2018 pending in the Court of learned S.D.J.M. (Sadar), Cuttack for offence punishable under section 52(a)(i) of the Odisha Excise Act, 2008.
The petitioner moved an application for bail before the learned Sessions Judge, Cuttack which was rejected on 29.06.2018.
Considering the submission made by the learned counsel for the petitioner that the petitioner is in custody since 18.06.2018 and in the meantime, the investigation has made substantial progress and after hearing the learned counsel for the State, I am inclined to release the petitioner on bail.
Let the petitioner be released on bail in the aforesaid case on furnishing bail bond of Rs.20,000/- (Rupees twenty thousand) with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin over the matter with further terms and conditions as the learned Court may deem just and proper.
The BLAPL is accordingly disposed of.
