Learned counsel for the petitioners submits that even accepting the F.I.R. version, all the ingredients for attraction of offence under section 3 S.C./S.T. (P.A.) are prima facie not fulfilled. Therefore, he urges for grant of anticipatory bail to this petitioners.
Learned counsel for the State opposes the move.
Considering the submissions and viewing the nature of accusations against the petitioners as well as other surrounding circumstances, it is directed that in the event the petitioners surrender before the court in seisin of the case in connection with Jatni P.S. Case No.325 of 2018 corresponding to T.R. Case No.2344 of 2018 on the file of learned Dist. & Sessions Judge-cum-Special Judge SC & ST, Bhubaneswar within two weeks hence, they shall be released on bail on such terms and conditions as would be deemed just and proper by the said court with.
