The petitioner prays for issuance of writ of mandamus against opposite party n
o.5 directing him to submit the name of the petitioner, as per the gradation list before the o
pposite party no.4 for appointment as an examiner in the Higher Secondary Examination, 2017.
It is stated by the learned counsel that the petitioner has gained sufficient
experience in the said post and has acquired Ph.D. in Oriya. So, she is eligible to be appoint
ed as examiner in the Higher Secondary Examination, 2017. Moreover, it is pointed out that in
the year, 2013 and 2014, she was appointed as examiner of the Higher Secondary Examination.
Keeping in view the aforesaid consideration, without expressing any opinion on
the merits of the claim of the petitioner, the writ petition is disposed of. The petitioner i
s directed to file an appropriate application before the opposite party no.5, who shall submit
the same before the opposite party no.4 within seven days from date of receipt of representat
ion giving his recommendation and findings on it. The petitioner may do well to annex all the
relevant documents to her representation and file the same within five days before the opposit
e party no.5. On such event, the representation being forwarded by the opposite party no.5, th
e opposite party no.4 shall consider the case of the petitioner and dispose of the representat
ion, after affording reasonable opportunity of hearing to the petitioner, within a period of t
en days therefrom. The opposite party nos. 4 and 5 shall act upon production of certified copy
of this order, which the petitioner undertakes to produce within seven days.
