16.03.2017 Heard learned counsel for the petitioner and learned Addl. Standing Counsel.
 The petitioner is apprehending arrest for the alleged commission of offences u
nder Sections 341, 323, 324, 307, 354-B and 506/34 of the IPC in G.R. Case No.203/2016 of the
court of learned SDJM, Bhanjanagar, arising out of Jagannathprasad P.S. Case No.54/2016.

 The injured has sustained grievous injury in the sense that his left ear has b
een severely bitten by Gandhi Naik, who happens to be brother of the present petitioner. No
specific allegation has been made against the present petitioner under Section 307 of the IPC.
 There is some general and omnibus allegation against the petitioner regarding the offence und
er Sections 354-B and 506 of the IPC but those offences are not punishable with terms of impri
sonment exceeding seven years. The offences under Sections 341 and 323 of the IPC are bailable
 in nature. The petitioner is a permanent resident of Panchabhuti, P.S. Jagannathprasad, Dist.
 Ganjam, which precludes any chance of his absconding from justice. There is no allegation tha
t the petitioner shall tamper with the prosecution evidence if released on bail. No criminal
antecedent is reported against the petitioner.

 Considering the aforesaid facts, the ABLAPL is allowed. In the event of his ar
rest in the aforesaid case, the petitioner shall be released on bail by the arresting officer
on such terms and conditions as deemed just and proper by him.

 The ABLAPL is disposed of accordingly.

Urgent certified copy of this order be granted as per rules.
