The grievance of the petitioner is that, though he has preferred an appeal bef
ore the Secretary, Housing and Urban Development Department, but the interim application of th
e appeal has not yet been taken up, and in the meantime the Rourkela Development Authority has
issued notice vide Annexure-5 for taking suitable action. As the interim application by the A
ppellate Authority has not yet been taken up, the petitioner is entitled to receive the interi
m protection under Article 226 of the Constitution of India.
Taking into consideration the facts and submissions, the writ petition stands
disposed of directing the parties to maintain statusquo, so far as the property involved in Mi
sc. Case No.70 of 2014 and the interim order shall be effective till the disposal of the appea
l pending before the Secretary, Housing and Urban Development Department.
The writ petition is accordingly disposed of.
Urgent certified copy of this order be granted as per rules.
