 Heard learned counsel for the petitioner and Mr. B.K. Dash, learned counsel appearing
for opposite party no.1.

2. Learned counsel for the petitioner submits that the petitioner has sought for certain
information under the R.T.I. Act from the O.P.S.C. As the information could be supplied on tim
e, he filed First Appeal. When he could not get the information in spite of the order by the F
irst Appellate Authority, the petitioner preferred Second Appeal No. 1812 of 2016 before the S
tate Information Commission, Bhubaneswar, but the same has not been disposed of so far. He sub
mits that necessary direction may be issued to the opp. Party no.1 to dispose of the Second Ap
peal early.

3. Mr. B.K. Dash, learned counsel for the opp. Party no.1 submits that due to congestion
of cases before the Second Appellate Authority, the Second Appeal could not be disposed of and
 if necessary direct ion is given, the appeal would be disposed of by the Commission in accord
ance with law.

4. Considering the submissions of learned counsel for both parties and the grievance bein
g limited one, without going to the merit of the case, the writ application is disposed of wit
h a direction to the petitioner to make an application for early hearing of the Second Appeal
before the opp. party no1 within a week, the opp. Party no.1 would dispose of the same, so als
o the Second Appeal within a period of three months from the date of filing of petition for ea
rly hearing before the opp. Party no.1. The writ petition is accordingly disposed of.
 Certified copy of this order be granted on proper application.

ehalf of opp. Party no.1.
