r. P.V. Balakrishna, learned counsel appearing for the opp.party no.1-Bank.
This writ petition has been filed challenging the possession notice da
ted 12.6.2014 (Anexure-4) issued by the opp.party no.1-Bank for taking possession of the mortg
aged property, for recovery of the loan dues with further prayer to direct the Bank to settle
the loan account by way of One Time Settlement.
Learned counsel for the opp.party no.1-Bank on instruction submits tha
t the request of the petitioner has already been accepted by the Bank. He submits that the loa
n account has been settled by way of OTS and the petitioner has in the meantime paid the first
instalment and is required to pay the second instalment by 30th September, 2017, in full and
final satisfaction of the loan dues.
In view of the above, learned counsel for the petitioner does not want
to press this writ petition.
Accordingly, the writ petition is dismissed as not pressed.
Issue urgent certified copy as per rules.
