This writ petition has been filed praying for a direction to the opposite parties-Bank
to settle the loan account of the petitioner by way of one time settlement.
Learned counsel for the petitioner submits that the petitioner had approached this Cou
rt earlier in WP(C) No.16579 of 2016 and this Court vide order dated 06.10.2016 had granted li
berty to the petitioner to file an application for one time settlement/rephasement/ compromise
before the opposite parties-Bank along with deposit of Rs.1,00,000/- with a further direction
to the Bank to consider the same in accordance with the rules and the guidelines.
Learned counsel for the petitioner submits that though the petitioner had deposited Rs
.1,00,000/- and filed an application for one time settlement in terms of the order dated 06.10
.2017, the Bank has not taken any action on the same. Accordingly, a prayer has been made to d
irect the Bank to settle the loan account of the petitioner by way of one time settlement.
Learned counsel for the opposite parties-Bank has produced photo copy of the letter da
ted 28.6.2017 and its acknowledgement in Court today to show that the application of the petit
ioner for one time settlement has been rejected under due intimation to the petitioner.
Considering the submissions made by the learned counsel for the parties, this writ p
etition is disposed of granting liberty to the petitioner to submit a fresh proposal to the op
posite parties-Bank for one time settlement of the loan account, which shall be considered by
the Bank in terms of its existing guidelines and as has been done in similar other cases.
