 3. 05.01.2017 Heard learned counsel for the petitioner. In sp
ite of notice and appearance of a set of counsels on behalf of the opposite party-husband, the
re is no appearance of any counsel in Court today.
This transfer petition has been filed at the instance of the wife seeking transfer of C.P.No.6
75 of 2015 from the court of Judge, Family Court, Bhubaneswar to the court of Judge, Family Co
urt, Rourkela.

 Considering that the wife-petitioner is an unemployed l
ady facing difficulties in attending the case at Bhubaneswar and the she is presently residing
 at Rourkela so also looking to the decision of Honble Apex Court reported in Sumita Singh vs.
 Kumar Sanjay and Anr. AIR 2002 (SC) 396, this transfer petition stands allowed by directing t
ransfer of C.P.No. 675 of 2015 from the Judge, Family Court, Bhubaneswar to the court of Judge
, Family Court, Rourkela.

 Petitioner is directed to produce a certified copy of this order before the
Judge, Family Court Bhubaneswar for transmitting the case record in C.P.No.675 of 2015, in suc
h event the Judge, Family Court Bhubaneswar shall transmit the aforesaid case record to the
 court of Judge, Family Court, Rourkela within a period of seven days from the date of product
ion of a certified copy of this order. Further, since the matter is transferred on the request
 of thewife-petitioner, this Court also records the undertaking of the wife-petitioner through
 her advocate not to seek any unnecessary adjournments in the matter.

 Issue urgent certified copy of this order

on proper application.
