This transfer petition has been filed at the instance of the wife seeking transfer of C.P.No.2
46 of 2013 from the court of Judge, Family Court, Khurda to the court of Judge, Family Court,
Nayagarh.
Considering the fact that the opposite party-husband ha
s no objection in the matter of transfer of the aforesaid Civil Proceeding, this transfer peti
tion stands allowed by directing transfer of C.P.No. 246 of 2013 from the Judge, Family Court,
Khurda to the court of Judge, Family Court, Nayagarh within one week from the date of product
ion of certified copy of this Courts order by the petitioner.
Considering the fact that the C.P. is pending since 2013, the parties are dir
ected to cooperate the court below for timely disposal of the proceeding and the Judge, Family
Court, Nayagarh is directed to see disposal of the proceeding within a period of six months.
It is open to the petitioner to file an application in respect of C.P.No.1of 2015 pending in
the same Court for hearing both the cases one after another, in such event the Judge, Family
Court, Nayagarh shall consider the same within a period of two weeks taking into consideration
the necessity of its being tagged along with the present C.P. Further, since the matter is
transferred on the request of thewife-petitioner, this Court also records the undertaking of t
he wife-petitioner through her advocate not to seek any unnecessary adjournments in the matter
