Heard learned counsel for the petitioner and learned counsel for the State.
The grievance of the petitioner is that she submitted written report dated 05.07.2016
(Annexure-1) before the Inspector-in-charge of Balasore Town Police Station alleging disturban
ces by one neighbour, Malati Behera, but no action thereon was taken. She therefore, prayed fo
r a direction to the IIC, Balasore Town Police Station to take appropriate action.
On the last occasion, the learned Additional Standing Counsel was directed to take ins
truction on the allegations made in the writ petition. Today, the learned Additional Standing
Counsel on instruction submits that no report dated 05.07.2016 as per Annexure-1 was received
by the IIC., Balasore Town Police Station. Instead, the petitioner has sent a representation
to the Superintendent of Police, Balasore dated 30.05.2016 making similar allegations, which
was forwarded by the Superintendent of Police to the IIC., Balasore Town Police Station on 11.
08.2016 and that the IIC. made a preliminary enquiry on the allegations therein and found that
there was some boundary dispute between the petitioner and her neighbour and demarcation had
been made by the local Tahasildar and that other allegations in the representation against the
neighbour were found to be false.
