3. 16.01.2017 Petitioners having been in custody in G.R. Case No. 134 of 201
6 arising out of Parjang P.S. Case No. 0138 of 2016 pending in the court of learned J.M.F.C.,
Parjang registered for alleged commission of offence punishable under section 395 IPC read wit
h sections 25 and 27 of the Arms Act have filed this application for their release on bail.
It is submitted by the learned counsel for the petitioners that co-accused Dip
u @ Dipak Behera similarly placed with these petitioners has in the meantime been released on
bail by order of this Court in BLAPL No. 6820 of 2016. He also submits that as yet no T.I.Para
de has been conducted in the case and the petitioners are languishing in custody since 28.09.
2016 when other two main culprits namely, Bapi @ Kamlesh Thamba and Raja @ Rajesh Sahu are y
et to be apprehended. In view of above, he urges that the detention of these petitioners in th
e case till conclusion of the trial in the facts and circumstances of the case is not warrante
d. So, he urges for release of the petitioners on bail.
