he learned counsel for the State.

 This is an application under Section 439 Cr.P.C. in connection with G.
R.Case No. 499 of 2017 arising out of Brajarajnagar P.S. Case No.72 of 2017 pending in the Cou
rt of learned S.D.J.M., Jharsuguda for offences punishable under Sections 399/402 of the India
n Penal Code.

 The petitioner moved an application for bail before the learned Addl.
Sesssions Judge, Jharsuguda which was rejected on 06.04.2017.

 Learned counsel for the petitioner submits that the petitioner is in c
ustody since 12.03.2017 and in the meantime, investigation has made substantial progress. It i
s stated that there is no such accusation so as to attract the ingredients of the offences und
er sections 399/402 of the IPC and therefore, the bail application of the petitioner may be fa
vourably considered.

 Learned counsel for the State has produced the case diary and submits
that there are criminal antecedent against the petitioner.

 Considering the submissions made by the learned counsel for the respec
tive parties, the nature of accusation against the petitioner and the period of detention of t
he petitioner in judicial custody, I am of the opinion that it is a fit case for grant of bail
 to the petitioner.

 Let the petitioner be released on bail in the aforesaid case on furnis
hing bail bond of Rs.20,000.00

(rupees twenty thousand) with two solvent sureties each for the like amount to the satisfactio
n of the Court in seisin
over the matter with further terms and conditions as he deems fit and proper with further cond
itions that he shall appear in person before the Brajarajnagar Police Station once in a week o
n every Sunday in between 4 p.m. to 6 p.m. till conclusion of the trial without fail and he sh
all also appear before the learned trial Court on each date of posting of the case and violati
on of any of the conditions imposed by this Court by the learned trial Court, the bail bond sh
all be liable to be cancelled.

Accordingly, the BLAPL is disposed of.

Urgent certified copy of this order be granted on proper application.
