Learned counsel for the petitioner submits that basing on the confessional sta
tement of co-accused, the petitioner has been arrayed as an accused and charge-sheet has alrea
dy been submitted and the main co-accused Muna Bata has already granted bail and therefore, th
e anticipatory bail application may be favourably considered.
Learned counsel for the State opposes the prayer for bail.
Considering the submissions of learned counsels for the respective parties, th
e nature of accusation against the petitioner and the fact that the co-accused has already bee
n released on bail, I am inclined to release the petitioner on anticipatory bail and according
ly, this Court directs that in the event of arrest of the petitioner in connection with the af
oresaid case, he shall be released on bail on furnishing bail bond of Rs.20,000/- (rupees twen
ty thousand) with two solvent sureties each for the like amount to the satisfaction of the arr
esting officer with further conditions that he shall make himself available for interrogation
by the I.O. as and when required and he shall not, directly or indirectly,
