This is an application U/S. 438 Cr. P.C.
Learned counsel for the petitioner submits that, the co-accused persons simila
rly circumstanced with the petitioner, have already been released on bail in the meantime and
the petitioners bail application be expeditiously disposed of on the same day, on his surrende
ring before the learned courts below.
Taking into consideration such submission, the ABLAPL is disposed of with the
observation that, the petitioner, if so advised, may surrender before the learned S.D.J.M., Dh
enkanal in Dhenkanal Sadar P.S. Case No. 250 of 2016 corresponding to G.R. Case No. 746 of 2
016 within 7(seven) days from the date of reopening of the court after the ensuring Summer Vac
ation. In the event of his surrender and motion for bail, his application for bail shall be di
sposed of on merit in accordance with law in the first hour. In the event of rejection of pray
er for bail, the petitioner is at liberty to move the higher forum in the second hour on the s
ame day. If such application is filed in the higher forum on the same day, the same shall be d
isposed on the same day. The Case Diary be made available to the courts concerned to facilitat
e disposal of the bail application.
