This is an application U/S. 438 Cr. P.C.
Learned counsel for the petitioner submits that, the petitioners bail applicat
ion be expeditiously disposed of on the same day, on his surrendering before the courts below.
In view of such submission, the petitioner, if so advised, may surrender befor
e the learned S.D.J.M., Hindol in Hindol P.S. Case No.102 of 2016 corresponding to G.R. Case N
o.319 of 2016 within fifteen days from today. In the event of his surrender and motion for bai
l, his application for bail shall be disposed of on merit in accordance with law in the first
hour. In the event of rejection of prayer for bail, the petitioner is at liberty to move the h
igher forum in the second hour on the same day. If such application is filed in the higher for
um on the same day, the same shall be disposed on the same day. The Case Diary be made availab
le to the courts concerned to facilitate disposal of the bail application.
The ground of parity, if canvassed by the petitioner, shall be taken into cons
ideration by the courts concerned.
The ABLAPL is accordingly disposed of.
