 The petitioner having been implicated in G.R. Case No. 355 of 2016 arising out of Naktideul P
.S. Case No. 69 of 2016 registered for alleged commission of offence under sections 448/294/18
9/506 IPC read with section 3 (1)(x) SC & ST (PA) Act pending in the court of learned S.D.J.M
., Rairakhol has filed this application under section 438 of the Cr.P.C. for grant of anticipa
tory bail.

 Learned counsel for the petitioner submits that the parties are having prior d
ispute even accepting the FIR averments, all the ingredients for attraction of offence under s
ection 3 of the SC & ST Act are prima facie not satisfied. In view of above, when there remain
s least scope on the part of the petitioner to flee from justice or tamper the evidence, he ur
ges for grant of anticipatory bail to this petitioner.

 Learned Addl. Standing Counsel opposes the move.

 Considering the submission, viewing the nature of accusations and other
 surrounding circumstances of the case, in the absence of any other impediment, it is directed
 that in the event the petitioner surrenders before the court in seisin of the case within a p
eriod of fifteen days hence and moves for his release on bail, he be released on bail on such
terms and conditions as would be deemed just and proper by the said court.
