 This is an application U/S. 438 Cr. P.C.

 Learned counsel for the petitioner submits that, the principal accused and oth
er co-accused persons similarly circumstanced with the petitioner have alrea
dy been released on bail and the petitioners bail application be expeditiously disposed of on
the same day, on his surrendering before the courts below.

 In view of such submission, the petitioner, if so advised, may surrender befor
e the learned S.D.J.M., Paralakhemundi in Paralakhemundi P.S. Case No.184 of 2016 correspondin
g to G.R. Case No.543 of 2016 within fifteen days from today. In the event of his surrender an
d motion for bail, his application for bail shall be disposed of on merit in accordance with l
aw in the first hour. In the event of rejection of prayer for bail, the petitioner is at liber
ty to move the higher forum in the second hour on the same day. If such application is filed i
n the higher forum on the same day, the same shall be disposed on the same day. The Case Diary
 be made available to the courts concerned to facilitate disposal of the bail application.

 The ground of parity, if canvassed by the petitioner, shall be taken into cons
ideration by the courts concerned.

 It is made clear that, the ground of parity does not mean how many days the ot
her accused persons are there in jail. It means whether the materials against the accused pers
ons released on bail and the present petitioner is the same or not?

 The ABLAPL is accordingly disposed of.

 Urgent certified copy of this order be granted as per rules.
