02. 06.01.2017 The petitioner having been implicated in Umerkote P.S.
Case No.356 of 2016 corresponding to G.R. Case No.1005 of 2016 registered for alleged commiss
ion of offence under sections 341/354/294/506/34, I.P.C. pending in the Court of the learned
J.M.F.C., Umerkote has filed this application for grant of bail in the event of his arrest in
the said case.
Learned counsel for the petitioner submits that the parties are having longsta
nding dispute and for that reason the case has been foisted against this petitioner levelling
the allegations which are highly improbable. Therefore, he urges for grant of anticipatory bai
l to the petitioner.
Learned Additional Government Advocate opposes the move.
Considering the submissions, in view of the nature of accusations and other su
rrounding circumstances of the case, in the absence of any other impediment, it is directed th
at in the event the petitioner surrenders before the court in seisin of the above mentioned ca
se within fifteen days and moves for bail, he be released on bail with such terms and conditio
ns as would be deemed just and proper by the said court.
The ABLAPL is accordingly disposed of.
Urgent certified copy of this order be granted on proper application.
