el for the State-opposite party.
Assailing the order of eviction dated 15.6.2010 passed by the Estate Officer,
S.E.Railway, Kharagpur, opposite party no.6, in Eviction Case No.E/22/2009/L-IV, Vide Annexure
-2 series, the present writ petition has been filed. Against the said order, appeal lies to th
e Collector, Balasore.
Learned counsel for the petitioner submits that liberty may be granted to the
petitioner to file appeal before the Collector, Balasore.
Considering the innocuous prayer, this writ petition is disposed of with an ob
servation that if the petitioner files appeal within a period of fifteen days from today, the
Collector, Balasore shall do well to dispose of the same within a period of three months there
after after affording opportunity of hearing to the petitioner. Till disposal of the appeal, s
tatus quo with regard to the disputed property shall be maintained by the parties.
