Learned counsel for the petitioner submits in respect of Plot No. 540 under Kh
ata No. 1166 measuring an area Ac.0.03 dec. of Mouza Khariar a encroachment proceeding was ini
tiated earlier. While the matter stood thus the opposite party alleged that petitioner has con
structed a boundary wall over Plot No. 543 which was adjacent to Plot No. 540. Without filing
the demarcation case petitioner has filed the writ petition to demarcate the Plot No. 543 and
settle the land in respect of Plot No. 540 though the same was subjudice till date.
In course of hearing learned counsel for the petitioner submits that petitione
r does not want to press this application as it has become infructuous.
Accordingly the writ petition is dismissed as infructous. S. Panda, J
