Heard Mr. Pradhan, learned counsel for the petitioner and Mr. Sharma, learned Standing
Counsel for the Transport Department.
Challenge is made to the auction sale notice, vide Annexure-3, issued by the Tax Recov
ery Officer-cum-Regional Transport Officer, Cuttack, opposite party no.1.
Mr. Pradhan, learned counsel for the petitioner, submits that the petitioner is ready
and willing to deposit the entire tax and penalty.
In view of the undertaking given by the learned counsel for the petitioner, this Court
disposes of the writ petition with an observation that if the petitioner deposits the entire
tax and penalty within a period of three days from today, the possession of the vehicle bearin
g registration No.OR05-AQ-9922 shall be handed over to the petitioner.
