06. 09.11.2016 This writ application has been filed for issuance of writ of m
andamus directing opposite party no. 2 not to interfere in any manner with the bifurcation of
college as regards the +2 and +3 Degree Wing said to have been already made by the Governing B
ody in accordance with the bifurcation policy of the State.
Learned counsel for the petitioner submits that in this matter few staff of +2
Wing college have submitted a grievance petition before opposite party no. 2 and pursuant to
the same, the Principal who is the Secretary of the Governing Body had been asked to produce a
ll the relevant documents and papers for verification for consideration of said grievance of t
he staff. He however submits that as yet no such final decision has been taken in the matter o
f said grievance petition. In view of the above, he contends for disposal of the writ applicat
ion at this stage with a direction to opposite party no. 2 to hear the petition and verify all
the relevant documents and papers before taking any action on the grievance petition.
Learned Addl. Government Advocate submits that this petitioner had been notice
d under Annexure -10 for the purpose. And therefore, in any event the decision on the said gri
evance petition if not already taken would be taken after giving due opportunity of hearing of
the petitioner.
Considering the submission, the writ application stands disposed of with a dir
ection to opposite party no. 2 that in the event the grievance petition as aforesaid is still
pending for consideration before taking any decision in the matter of the said grievance petit
ion of Shri Bhagaban Dash and others who are the staff of the Junior College, the petitioner w
ould be given due opportunity of hearing with production of necessary documents and papers for
verification.
The writ application is accordingly disposed of.
