06. 09.11.2016 The petitioners having been implicated in Niali P.S. Case No.
138 of 2016 corresponding to G.R. Case No. 1073 of 2016 on the file of learned J.M.F.C.(R), Cu
ttack for alleged commission of offence under section 290/147/323/324 /307/506/149 of IPC, hav
e filed this application for grant of bail in the event of their arrest in the said case.
Learned counsel for the petitioners submits that there is a case and counter c
ase of the said incident where the members of the prosecution parties have also been severely
injured and in order to get rid of that case, the present case has been foisted these petition
ers who are the members of one family. According to him the versions are all exaggerated.
Learned counsel for the State submits that despite several informations, the i
njury reports have not yet been sent by the I.O.
Considering the submissions, viewing the nature of accusations and other surro
unding circumstances of the case, in the absence of any such available material to counter the
submission of learned counsel for the petitioners when there stands no other impediment, it i
s directed that in the event of arrest of the petitioners in the above case, they be released
on bail with such terms and conditions as would be deemed just and proper by the Arresting Off
icer with further condition that they will cooperate with the investigation; and will not thre
aten or terrorize the prosecution witnesses.
