W. P.(C) No. 185 of 2016 Heard Mr. S.Mohanty learned counsel for the petitioner.
The petitioner has filed this petition seeking for a direction to opposite party no. 2
to issue the place of his posting at S.A. Mahabidyalaya Balipatna Bhubaneswar in pursuance to
the letter vide G.O No. 23.116/HE dated 15.10.2015.
Learned counsel for the petitioner submit that the joint Secretary of the Government in
the department of Higher Education by letter dated 16.11.2015 directed the Director, Higher E
ducation to furnish the name of the suitable substitute to the Department immediately and to c
arry out the Government order under reference in respect of the petitioner as committed to the
Chief Secretary, Odisha vide letter dated 07.08.2015 and therefore the petitioner may be perm
itted to make a fresh representation to the Director, Higher Education to consider his case in
the light of the said Government letter dated 16.11.2015 vide Annexure-4.
In view of the aforesaid limited grievance of the petitioner without expressing any opi
nion on the merits of the case, this Court disposes of the writ petition directing the petitio
ner to file a fresh representation before opposite party no.2 within a period of ten days and
if such a representation is filed, the opposite party no.2 shall consider and dispose of the s
ame on the basis of the Government letter dated 16.11.2015 vide Annexure-4 within a period of
two weeks thereafter.
