04. 08.08.2016 Considering the limited challenge to the order of acceptance o
f the counter claim filed by the opposite party no. 6 as defendant no. 6 in the trial court co
ncerning the payment of court fee as regards deficit in payment of the same, upon hearing the
learned counsel for the parties and on going through the impugned order in the absence of any
challenge to it on any other ground on merit with regard to acceptance of the counter claim, t
his Court feels inclined to dispose of the writ application with the observation that the tria
l court would do well to decide this aspect with regard to payment of court fee on the counter
 claim looking to its prayer and accordingly pass necessary direction for its deposit in accor
dance with law while disposing the suit and counter claim.
