The petitioner is a loanee of the sole opposite party Bank. It is asserted by the p
etitioners counsel that the petitioner is repaying the loan regularly. By taking the loan, th
e petitioner is stated to have built a two-storied house. Now the first floor of the house is
proposed to be rented by the petitioner, and for that matter the petitioner has applied for i
ssuance of NOC from the opposite party Bank.
It is submitted by learned counsel for the petitioner that in this regard the petiti
oner has filed a representation before the opposite party Bank, vide Annexure-2, but the oppos
ite party Bank is not taking any decision on the said representation, and it is also asserted
by learned counsel for the petitioner that the rent the petitioner shall get by letting out hi
s house shall be paid to the opposite party Bank towards liquidation of the loan amount.
Taking into consideration the limited grievance of the petitioner and without going
into the merit of the case, the opposite party, i.e. Asst. General Manager, State Bank of Indi
a, Talcher, Fertilizer Township, Vikrampur is directed to dispose of the representation of the
petitioner, vide Annexure-2 to the writ petition, in accordance with the Banks Regulation, on
merit, within two months from the date of receipt of a certified copy of this order along wit
h copy of the writ petition containing all the Annexures.
