The petitioner is aggrieved by the fact that, a C.C. Road is being constructed
by the Block Authorities of Basta Block in the district of Balasore on the Sthitiban land of
the petitioner.
In this regard, the petitioner is stated to have filed a representation before
the Collector, Balasore, who is competent U/S. 109 of the Orissa Grama Panchayat Act to deal
with the matter.
Taking into consideration the limited grievance of the petitioner and without
going into the merit of the case, the writ application is disposed of directing the Collector,
Balasore Opp. Party No.2, to dispose of the representation of the petitioner vide Annexure
3, within six weeks from the date of receipt of a certified copy of this order along with a co
py of the writ application containing all the Annexures.
Till disposal of the representation by the Collector, Balasore, no constructio
n be undertaken on the land question belonging to the petitioner.
The writ application is accordingly disposed of.
Urgent certified copy of this order be granted as per rules.
