04. 22.11.2016 This writ petition has been filed in the nature of public interest of
litigation praying for a direction to the opposite parties to return the amount provided from
the Chief Ministers Relief Fund to Ahar Yojana.
On the last occasion, this Court had directed the petitioner to file the Ahar
Yojana, which has not been filed. The scheme of the Chief Ministers Relief Fund has also not b
een filed so as to enable us to decide as to what relief can be granted under the Scheme. Anne
xure-1 has been filed stating that the same is a scheme of the Chief Ministers Relief Fund. Bu
t on perusal of the same, it is revealed that the same is in the questionnaire form with regar
d to Chief Ministers Relief Fund. In the said document itself, it is mentioned that in case th
ere is any complaint, the party may approach the Joint Secretary to Government, Department of
General Administration, Odisha Secretariat, Bhubaneswar.
Such being the position, especially when neither the Chief Ministers Relief Fu
nd Scheme has been filed by the petitioner nor the petitioner has produced the Ahar Yojana des
pite order of this Court, we would not be inclined to grant any relief.
The writ petition is accordingly dismissed.
