03. 18.08.2016 The appellant-petitioner, being aggrieved by the order of reco
very issued against him, filed writ petition bearing W.P.(C) No.1300 of 2015, which has been d
isposed of. Against which the present appeal has been filed.
Admittedly, the recovery certificate was issued on the basis of recovery direc
ted by the Stamp Collector, which order has not been challenged by the petitioner-appellant ei
ther in the writ petition or in the appeal.
In absence of such order having been challenged, no relief could have been gra
nted to the petitioner. As such, we dispose of the appeal with the observation that disposal o
f W.P.(C) No.1300 of 2015 will not come in the way of the appellant-petitioner challenging the
order of the Stamp Collector imposing stamp duty on the petitioner, in accordance with law, b
efore the appropriate forum.
With the aforesaid observation, the writ appeal is disposed of.
