This is an application for modification of the order dated 10.09.2016 and for
refund of the statutory deposit made by the appellant along with the accrued interest.
Learned counsel for the appellant-Insurance Company submitted that though he h
as withdrawn the appeal on 10.09.2016 but inadvertently he could not pray for release of the s
tatutory deposit of Rs.25,000/- (rupees twenty five thousand) which was made before this Court
by the appellant on 17.01.2011 vide cheque no.335534 drawn on Indian Overseas Bank, Saheed Na
gar and kept in fixed deposit in Nationalised Bank as per the order of this Court dated 11.03.
2011.
Considering the submissions made by the learned counsel for the petitioner, th
e statutory deposit along with accrued interest shall be refunded to the appellant.
Misc. case is disposed of.
