Heard learned counsel for the parties.
This appeal by the claimant-appellant is directed against the judgment/award dated 13.8
.2014, passed by the Railway Claims Tribunal, Bhubaneswar Bench, Bhubaneswar, in Case No. OA/I
Iu/2011/0021, dismissing the claim application of the appellant.
Learned counsel for the claimant-appellant submits that as the deceased Bikash Chandra
Swain was a bonafide passenger in 5 CP Passenger train and died in an untoward incident on 04.
7.2010, learned Tribunal was not justified in dismissing the claim application. In this regar
d, it is submitted that as the photocopy of the ticket did not reveal the correct number, lear
ned Tribunal disbelieved the case of the claimant that the deceased was a bonafide passenger i
n 5 CP Passenger train, though the untoward incident was admitted. It is submitted that in th
e meantime, the claimant has obtained information from the Sr. Divl. Commercial Manager, East
Coast Railway, Khurda Road, under R.T.I. Act, with regard to the particulars of the ticket, wh
ich has been filed as additional evidence, to show that the deceased was a bonafide passenger
in the train and died in an untoward incident on 04.7.2010.
It is submitted that as the said document issued by the office of Sr. Divl. Commercial
Manager, East Coast Railway, Khurda Road, dated 26.9.2014 has been obtained after the passing
of the impugned award, the claimant be given an opportunity to produce the same before the lea
rned Tribunal.
