This application has been filed challenging the order dated 12.11.2015, passed by the
learned District Judge, Khurda at Bhubaneswar, in CMA No.245 of 2014, rejecting the applicatio
n of the petitioner filed under Section 151 CPC for removal of obstruction over the suit passa
ge.

During course of hearing learned counsel for the petitioner prays for withdrawal of th
e application, with liberty to file a fresh application with better particulars for removal of
such illegal and unauthorised constructions made over the suit property, in violation of the
interim order of status quo.

Granting such liberty, CMP is disposed of as withdrawn.
